NOTICE OF PUBLIC HEARING AND SPECIAL ZONING BOARD OF APPEALS MEETING

In accordance with the Michigan Open Meetings Act, Public Act 267 of 1976, MCL 15.261, et. seq., the Zoning Board of Appeals will hold a public hearing at a special meeting on Thursday, August 7, 2025, at 5:00 PM*

The purpose of this meeting is the variance requests listed below:

  • 115 N Barton, LLC owner of 115 N Barton St, New Buffalo, MI 49117. The applicant requests the following five (5) variances.
  • To reduce the drive aisle from 24 feet to 19 feet, 3 inches, per the City’s Zoning Ordinance Section 5-01 (B)(6).
  • To allow the building entry door orientation to not face the street, per the City’s Zoning Ordinance 3-05 (D).
  • To allow parking to be located under the principle building instead of the rear of the principal building, per the City’s Zoning Ordinance Section 3-05(C) E.
  • To reduce the interior West side setback to allow for parking, per the City’s Zoning Ordinance Section 3-01 (A).
  • To reduce the required front setback to allow parking to be within 10 feet of a street right-of-way line, per the City’s Zoning Ordinance Section 5-01(B) 3.

Zoning District: CBD (Central Business District)

Said property is located at 115 N Barton St, New Buffalo, MI 49117. Property Tax Code is 11-62-0340-0141-00-8.

  • 45 S Whittaker New Buffalo LLC, owner of 45 S Whittaker, New Buffalo, MI 49117. The applicant requests a use variance for the purpose of changing the use of the building from business to residential use, per the City’s Zoning Ordinance, table 3-04 (B).

Zoning District: CBD (Central Business District)

Said property is located at 45 S Whittaker, New Buffalo, MI 49117.  Property Tax Code is 11-62-0340-0343-00-0.
